John Maitland was the only son of John Maitland, Lord Maitland of Thirlestane, and Jean, only daughter and heir of James Fleming, 4th Lord Fleming. He succeeded his father as Lord Maitland of Thirlestane 3 October 1595. He married Isabel Seton, second daughter of Alexander, Earl of Dunfermline before 18 June 1610. He was President of the Council and one of the ordinary Lords of Session 1618-1626, and an extraordinary Lord of Session 1626-1628. He was created Viscount Lauderdale 2 April 1616, and Lord Thirlestane and Boltoun, Viscount Maitland, and Earl of Lauderdale 14 March 1624. He was Commissioner for the plantation of Kirks in 1617 and 1621, and a Commissioner of the Scottish Parliament 1621, Commissioner of Taxes 1634 ,and President of the Parliament from 1644 until his death 18 January 1645. He was succeeded by his son, John Maitland, 2nd Earl and 1st Duke of Lauderdale. He used Stamp 4 until his elevation to the Dukedom in 1672.
